FAI/SoundExchange Match Program Generates over $50K!!!
 
We are pleased to announce that the 2009 Folk Alliance/SoundExchange royalty match program generated over $50,000 in found digital royalties for current Folk Alliance members.  
 
SoundExchange is a non-profit performance rights organization that collects statutory royalties from satellite radio (such as SIRIUS XM), internet radio, cable TV music channels and similar platforms for streaming sound recordings.  The Copyright Royalty Board, which is appointed by The U.S. Library of Congress, has entrusted SoundExchange as the sole entity in the United States to collect and distribute these digital performance royalties on behalf of featured recording artists, master rights owners (like record labels), and independent artists who record and own their masters.

****NEW MEMBER SERVICE ANNOUNCED


FAI PRO (PERFORMING RIGHTS ORGANICATIONS) AGREEMENT
Folk Alliance International is pleased to announce the first phase of our newest member service – The U.S. PRO House Concert Presenter Agreement.
 
FAI has reached an agreement with ASCAP and BMI to ensure that Folk Alliance member House Concert Presenters are not subject to any PRO fees.
 
There is NO additional fee or change in membership status to qualify for this member service, but you must be a current member to quality for this program.
 
To qualify for FAI House Concert member service, a House Concert presenter must:

  1. Be a member in good standing in Folk Alliance International
  2. Complete, sign & return a form agreeing to abide by the established rules for official house concerts *see rules below (form available September 1, 2009)
  3. Post the numbered and dated “official FAI House Concert” logo on their House Concert website


That’s it. Forms and logo will be updated each time your membership is renewed.  No FAI member is required to participate in this program. Participation is voluntary.
 
By signing up for this program, you will assure that as long as you are presenting music in compliance with House Concert established rules; you will not be subject to PRO payments for your House Concerts.  By displaying the official FAI House Concert logo, the PRO’s will know you are official.  At that point, if they have questions, they will contact the FAI office.
 
House Concert Rules and Regulations:

  1. Performance is in a private home
  2. Performance is by invitation only*
    1. *the intent of the “invitation only” regulation is that a person cannot just come without some connection to the presenter or artist (i..e. a “wide circle of family and friends”) The details of that compliance might include but not be limited to 1) not publicly displaying your address  2) “by invitation only” or “call for invitation” on all information accessible to the public (i.e. website, flyers)


The next phases of this agreement will deal with coffee shops and non profit presenters working in community buildings, schools, and churches.  We are also working with the PRO’s in the way they deal with our festivals.
 
As you are aware, this is a very large and complicated negotiation that will still take time to finalize all phases of this potential agreement.  
 
We will continue the discussion on these topics as we move through the process.   Big thanks to Renee Bodie, BMI, ASCAP, and everyone that took part in the PRO committee and discussions.

Our organization and conference are special because it is truly a community event as a result of the concerted effort of hundreds of volunteers, the music of hundreds of talented musicians, and the loyalty and passion of the thousands of people who make the journey to the conference each year.  All of this combines to create four great days and years of lasting friendships, fond memories, new business opportunities, and incredible music. The Organization’s year-round events, too, need the support of the community to remain vibrant and accessible to all.

Your Tax Deductable donation to Folk Alliance allows us to provide conference scholarships to enhance our ongoing youth and diversity development.  Since 2005, Folk Alliance has provided scholarships to over 100 conference attendees.

The Folk Alliance Scholarship Program also provides a way for us to honor our longtime members that are no longer with us.  In 2010, scholarships will be awarded in the names of Elaine Weissman, Utah Phillips, Victor Heyman, Phillip Davidoff, Sean LaRoche, and others.

Set Up and Load Out: Exhibitors may load in Wednesday afternoon beginning at 2:00pm and Thursday beginning at 12:00pm. All load out must be completed on Saturday by 8:00pm. FA will not be responsible for anything left in the exhibit hall.

Exhibit Hall Contract Agreement: Terms & Conditions (aka The Fine Print)
By signing up for Exhibit space, you agree to comply with the terms and conditions of the contract below, and other such rules or operating procedures as deemed necessary for conducting the Exhibit Hall in an orderly fashion.
I. Exhibit Space and Materials
The Folk Alliance 2009 21st Annual International Conference, herein referred to as Conference Management, agrees to provide, upon payment of the agreed upon fee, either one approximately 10 foot by 10 foot booth OR one half booth in the exhibit area from 2:00 pm (local time Memphis, TN) on Wednesday, February 20, 2009 until 8:00 pm (local time Memphis, TN) on Saturday, February 23, 2008. Booths will be furnished with two chairs, a sign, a 6ft draped table, and a wastebasket. All other services and/or supplies must be obtained at the exhibitor’s own expense.
II. Security
Conference Management will provide security staff at all times from 2:00pm (local time Memphis, TN) on Wednesday, February 20, 2009 until 8:00pm (local time Memphis, TN) on Saturday, February 23, 2008. The exhibitor at his/her expense must provide any additional security needs. Exhibitors are responsible for their own property and neither Conference Management, the exhibit facility, the North American Folk Music and Dance Alliance, nor service contractors hired by Conference Management will accept any liability for loss or theft. Please note Folk Alliance cannot guarantee security of items.
III. Cancellations and Refunds
Exhibit hall fees are refundable (minus a $50 handling fee) until December 1, 2007. Those cancelling between December 2, 2008 and January 4, 2009 will receive dollar value credit (less a $50.00 handling fee) towards the 2009 conference in Memphis, TN. Conference credits cannot be used towards membership fees nor do they guarantee future exhibit space. There are absolutely no refunds or credits for cancellations post January 2, 2008. Cancellations after January 4 due to weather or other events cannot be credited. There are no substitutions of participants allowed except in case of company employees, which will be determined on a case by case basis by the Folk Alliance office.
IV. Aisle Integrity and Unauthorized Showcasing
All exhibitor products, display materials, tables, chairs, signs, etc. must be confined inside the actual limits of their assigned booths. Exhibitors and attendees are welcome to demonstrate and play exhibited instruments in exhibit booths. However, performances by organized groups or individual performers, except those organized by the Folk Alliance, are considered unauthorized showcasing and strictly prohibited. All recorded music must be played through headphones out of respect for your fellow exhibitors.
V. Subcontracting of Exhibit Space
No exhibitor shall be permitted to subcontract assigned exhibit space(s). No more than one company shall be permitted to contract or occupy each exhibit single space without application to and permission from Conference Management. There will be only one contact address listed per exhibit space.
VI. Limitations and Liability
The exhibitor covenants and agrees to defend, indemnify and hold harmless the Memphis Convention Center, the city of Memphis that owns and operates Center, their officers, directors, and employees, and the North American Folk Music and Dance Alliance, Inc., its directors, officers, employees, volunteers and contractors, from any and all liability, damage, or expense, direct or consequential, arising out of, or connecting with, an injury to any person while in the exhibitor’s exhibit area, or loss, theft, damage, reasonable attorney expenses or injury to property resulting directly or indirectly from any act or omission of the exhibitor, its agents and contractors or failure of the exhibitor to comply with any of the terms and conditions of this contract, or of the rules and regulations of the 20th Annual International Folk Alliance Conference, or the ordinances of the City of Memphis, or of the laws of the State of Tennessee, or the Government of the United States.
Conference Management shall not be responsible for any failure to perform any of its obligations hereunder in the event the premises in which the show is to be held becomes, in the judgment of Conference Management, unfit for occupancy for any reason beyond the control of Conference Management and which cannot be overcome by diligent effort. In the event of termination by Conference Management as a result of the aforesaid causes, the exhibitor expressly waives such liabilities and releases the North American Folk Music and Dance Alliance of and from all claims for damages and agrees Conference Management shall have no obligation to the exhibitor except to refund to the exhibitor the fee paid for exhibit space, less a proportionate share of all expenses incurred by Conference Management for the show. Neither the North American Folk Music and Dance Alliance, the facility, nor its service contractors will be responsible for loss or damage of any merchandise while in transit to or from the show site, nor while at the show site.
VII. Insurance
Exhibitors are urged to maintain insurance and are responsible for obtaining it through their own sources and at their own expense. Any such policy shall name the North American Folk Music and Dance Alliance as additional insured as the respective interests may appear. Exhibitors are encouraged to maintain the following types and amounts of insurance: (i) commercial general liability (including contractual liability) of at least $1,000,000 occurrence/$2,000,000 aggregate, (ii) property insurance in an amount not less than the combined current replacement cost of all property of the exhibitor and their employees/guests on site, (iii) automobile liability, amounts as required by law and (iv) worker compensation as required by all applicable laws.
VIII. Rules, Regulations, Contract Terms, and Amendments
Conference Management shall have full power in the interpretation and enforcement of all rules contained herein and in the Rules and Regulations. Conference Management shall also have the power to make such reasonable contract amendments and such further Rules and Regulations as it shall consider necessary for the proper conduct of the show, provided these do not materially alter or change the contractual rights of the exhibitor. All amendments that may be so made shall be binding on all parties affected by them as by the original regulations.
